1. Acceptance of Terms
By downloading, installing, or using the Flexi mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Description of Service
Flexi is a fitness community application that allows users to:
- Track and log workout activities
- Share fitness-related posts and photos
- Interact with other users through likes, comments, and messages
- Purchase in-app currency (Energy) for additional features
3. User Accounts
To use certain features of the App, you must create an account. You are responsible for:
- Providing accurate and complete information
- Maintaining the security of your account
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4. Zero Tolerance Policy
Flexi maintains a strict ZERO TOLERANCE policy for the following behaviors:
- Harassment, bullying, or intimidation of any kind
- Hate speech, discrimination, or content promoting violence
- Sexually explicit, pornographic, or obscene content
- Content depicting or promoting illegal activities
- Spam, scams, or fraudulent behavior
- Impersonation of other individuals or entities
- Sharing of personal information of others without consent
- Any content that exploits or endangers minors
- Threats of violence or harm to any person
Violation of this policy will result in immediate and permanent account termination without warning or refund. We reserve the right to report illegal activities to appropriate law enforcement authorities.
5. User Content
You retain ownership of content you post on Flexi. However, by posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App.
You are solely responsible for the content you post and must ensure it:
- Does not violate any laws or regulations
- Does not infringe on any third-party rights
- Complies with our community guidelines and zero tolerance policy
6. In-App Purchases
Flexi offers in-app purchases for Energy credits. By making a purchase, you agree to the following:
- All purchases are processed through Apple's App Store
- Purchases are final and non-refundable, except as required by applicable law
- Energy credits have no cash value and cannot be exchanged for real currency
- We reserve the right to modify pricing and offerings at any time
- Refund requests must be directed to Apple in accordance with their refund policies
7. Prohibited Activities
You agree not to:
- Use the App for any illegal purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Use automated systems or bots to access the App
- Collect or harvest user information without consent
- Circumvent any security measures
8. Reporting and Blocking
Flexi provides tools to report inappropriate content and block other users. We encourage users to report any violations of these Terms or our community guidelines. We will review reports and take appropriate action, which may include content removal and account termination.
9. Intellectual Property
The App and its original content, features, and functionality are owned by Flexi Inc. and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our App without our express written permission.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEXI INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
12. Indemnification
You agree to indemnify and hold harmless Flexi Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
13. Account Termination
We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms. You may also delete your account at any time through the App settings.
14. Changes to Terms
We may modify these Terms at any time. We will notify users of significant changes through the App or by other means. Your continued use of the App after changes constitutes acceptance of the modified Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
